The following terms and conditions (“Terms”) apply to any Sanctuary+Health  Inc. (“Company”) Gift Card originally purchased at any participating Company location or on the Company’s website (www.sanctuary-health.org) (“Site”) (collectively, the “The Sanctuary+Health Gift Card”). 

 

By purchasing Sanctuary+Health Gift Card, accepting and retaining Sanctuary+Health Gift Card, or using Sanctuary+Health Gift Card, you agree to these Terms. The Company reserves the right to change, amend or terminate the Terms of the Sanctuary+Health Gift Card program at any time with or without notice in our sole discretion, subject to applicable law.

 

Use of Sanctuary+Health Gift Card

You may use Sanctuary+Health Gift Card only to purchase eligible merchandise and pay for services at Sanctuary+Health.

 

Redemptions/Balances

Your use of Sanctuary+Health Gift Card is limited to the current dollar value held on the card. You may obtain your balance by presenting Sanctuary+Health Gift Card at a Company location. Sanctuary+Health Gift Cards may not be redeemed for cash, except to the extent required by law.

 

Restrictions

You may not return, resell or use any Sanctuary+Health Gift Card for any unauthorized advertising, marketing, sweepstakes or other promotional purposes.

 

No Expiration Date/Service Charges

Sanctuary+Health Gift Card has no expiration date, service charges or dormancy fees.

 

Lost or Stolen Cards

Protect your Sanctuary+Health Gift Card as if it were cash and safeguard Sanctuary+Health Gift Card from unauthorized use. Except where required by applicable law, neither Issuer nor Sanctuary+Health is responsible for and will not replace Sanctuary+Health Gift Cards if lost, stolen, damaged or destroyed.

Misuse of the Card

The Company reserves the right in its discretion to suspend or terminate use of any Sanctuary+Health Gift Card if the Company suspects any fraud or misuse of Sanctuary+Health Gift Card. Issuer or Sanctuary+Health may cancel the Sanctuary+Health Gift Card at any time, without notice, subject to applicable law.

 

Property Rights

The consideration paid for Sanctuary+Health Gift Card, including any unredeemed balances, is the property of the Company.

No Warranties

Subject to applicable law, the Company make no warranties, express or implied, with respect to Sanctuary+Health Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. The Company does not assume any responsibility for any loss of any kind arising out of your use of any Sanctuary+Health Gift Card. In the event Sanctuary+Health Gift Card is not functional, your sole remedy and the Company’s sole liability shall be the replacement of Sanctuary+Health Gift Card at its then-current value.

 

Governing Law

The laws of the State of New York govern Sanctuary+Health Gift Card and these Terms, without regard to choice of law principles.

 

Severability

If any one or more of the provisions of these Terms shall be for any reason whatsoever held invalid, then such provisions shall be deemed severable from the remaining provisions and shall in no way affect the validity or enforceability of the other provisions of these Terms.

 

Entire Agreement

Except as specifically stated otherwise, these Terms set forth the entire understanding relating to the subject matter hereof, and all prior understandings, written or oral, are superseded by these Terms.
